These General Terms and Conditions of Sale apply exclusively, excluding any other conditions, particularly those applicable to in-store sales or sales via other distribution and marketing channels.
These General Terms and Conditions of Sale are accessible at all times on the website https://halloftime.be/ and, if necessary, will prevail over any other version or contradictory document.
The Customer declares that they have read and accepted these General Terms and Conditions of Sale by checking the designated box before initiating the online ordering process, as well as the general conditions of use of the website https://halloftime.be/.
These General Terms and Conditions of Sale may be subject to subsequent modifications; the version applicable to the Customer’s purchase is the one in effect on the website at the date of the order.
Unless proven otherwise, the data recorded in the Seller’s IT system constitutes proof of all transactions concluded with the Customer.
In accordance with the French Data Protection Act (“Informatique et Libertés”) dated January 6, 1978, the Customer has the right at any time to access, rectify, and object to all their personal data by sending a written request, accompanied by proof of identity, to:
Hall of Time, Avenue Louise 75R, 1050 Brussels.
The validation of the order by the Customer implies full and unconditional acceptance of these General Terms and Conditions of Sale.
The Customer acknowledges having the required legal capacity to enter into contracts and to acquire Products offered on the website https://halloftime.be/.
For orders placed to countries other than Belgium, the Customer acts as the importer of the Products concerned.
Customs duties, local taxes, import duties, or state taxes may be payable. These fees are the sole responsibility of the Customer.
For sales outside Belgium, it is the Customer’s responsibility to inform themselves about the applicable laws in the countries concerned, ensure compliance with any constraints imposed, and translate the terms of sale into the appropriate languages if necessary.
Changes to these General Terms and Conditions of Sale become binding to users of the website https://halloftime.be/ from the time they are published online, and cannot be applied retroactively to transactions previously concluded.
Article 2 – Orders
The Customer is responsible for selecting the Products they wish to order on the website https://halloftime.be/, following this procedure:
- Clicking the “Add to Cart” button;
- Reviewing the cart and selecting a delivery method;
- Entering billing and delivery information;
- Choosing the payment method and entering payment details;
- Confirming the payment.
Contractual information is presented in English and confirmed no later than the moment the Customer validates the order.
Product offers remain valid as long as they are visible on the website, subject to availability.
The sale will be considered final only after the Seller sends the Buyer confirmation of order acceptance by email, and after full payment—including any required deposit—has been received by the Seller.
The Customer is responsible for verifying the accuracy of their order and must immediately report any errors.
Any order placed on the website https://halloftime.be/ constitutes the formation of a distance-selling contract between the Customer and the Seller.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is an ongoing dispute regarding the payment of a previous order.
The Customer will receive updates about their order status via email.
The Seller does not sell Products through the website https://halloftime.be/ to professional buyers; sales are exclusively intended for consumers purchasing for personal use.
Therefore, the Seller reserves the right to refuse orders containing large quantities of the same Product—specifically, orders exceeding ten (10) identical items. The Seller also reserves the right to cancel or refuse any order in the event of a pricing error, particularly if the displayed price is significantly lower than the actual price or clearly incorrect.
Any modifications requested by the Customer to their order can only be taken into account by the Seller within reasonable limits and provided the Seller receives written notification by email or fax at least five (5) days before the scheduled shipping date.
In the event these modifications cannot be accepted by the Seller, the amounts already paid by the Customer will be refunded within a maximum period of thirty (30) days from the date the Seller notifies the Customer that requested modifications cannot be accepted (unless the Customer prefers store credit).
If the Customer cancels the order after its acceptance by the Seller less than two (2) days before the scheduled date of delivery of the ordered Products, for any reason other than exercising their right of withdrawal or force majeure, the Seller is entitled to retain and invoice the Customer an amount equal to 10% of the total purchase amount as compensation for damages incurred.
Article 3 – Prices
Products are supplied at the current prices listed on the website https://halloftime.be/ at the time the Seller records the order. All prices are stated in Euros (€), inclusive of all taxes (VAT included).
These prices take into account any discounts offered by the Seller on the website https://halloftime.be/.
Prices are firm and non-negotiable during their validity period, as indicated on the website https://halloftime.be/. However, the Seller reserves the right to modify prices at any time outside this validity period. Prices do not include processing, shipping, transportation, or delivery charges, which are billed separately under the conditions stated on the website https://halloftime.be/ and calculated prior to the confirmation of the order.
The total amount requested from the Customer corresponds to the full purchase price, including these additional costs.
An invoice will be issued by the Seller and provided to the Customer upon delivery of the ordered Products.
Article 4 – Precious Metals and Gemstones
Diamonds originate from legitimate sources not involved in funding armed conflicts, in compliance with United Nations resolutions; this guarantee is based on our knowledge and/or written assurances provided by our suppliers.
The use of colourless fluids and heating are recognized as traditional lapidary practices, used in addition to cutting and polishing certain coloured gemstones, as is pearl bleaching.
Gemstones may have undergone these standard enhancement practices.
Any other treatments are explicitly disclosed with the term “treated”.
Article 5 – Payment Terms
The full price is payable immediately by the Customer at the time of placing the order, using secure payment methods via credit card (VISA, Mastercard).
Payment data is securely encrypted using HTTPS protocol.
Article 6 – Delivery
The Products ordered by the Customer will be shipped within countries of the European Union within two (2) business days from the order date. In addition to this preparation time, processing and delivery times to the address provided by the Customer at the time of the order on the website https://halloftime.be/ must also be taken into account.
Delivery is considered completed upon transfer of physical possession or control of the Product to the Customer.
Except in special circumstances or in the event of the unavailability of one or more Products, all ordered Products will be delivered in one shipment.
The Seller undertakes to make its best efforts to deliver the Products ordered by the Customer within the above-specified timeframe. However, these timeframes are provided for informational purposes only. Nevertheless, if the ordered Products have not been delivered within thirty (30) days following the indicative delivery date, for any reason other than force majeure or due to the Customer’s own fault, the sale may be cancelled upon the Customer’s written request, under the conditions set forth by articles L216-2, L216-3, and L241-4 of the Consumer Code. Amounts already paid by the Customer will then be refunded within fourteen (14) days following the date of cancellation of the contract, excluding any compensation or deduction.
The Seller also offers free in-store pickup at the following boutique: Hall of Time, Avenue Louise 75R, 1050 Brussels.
The Seller advises the Customer to carefully inspect the Product upon delivery. Should the delivered Product not conform to the order (incorrect Product, defective, damaged, or incomplete Product), the Customer should submit written reservations within five (5) days following delivery, to the carrier and/or to the Seller.
In all cases, the provisions outlined in Article 9 concerning legal warranties will apply.
For Products reported as non-conforming within five (5) days following delivery, the Seller allows the Customer to exercise the right of withdrawal and obtain a refund of the Product without proceeding through repair or replacement, as provided by the statutory conformity warranty.
Article 7 – Transfer of Ownership and Risks
Ownership of the Seller’s Products shall be transferred to the Customer upon acceptance of the order by the Seller, signifying the agreement between the parties concerning both the item and the price, regardless of the actual date of payment or delivery.
Article 8 – Right of Withdrawal
In accordance with current legal provisions, the Customer has fourteen (14) days from the date of receipt of the Product to exercise the right of withdrawal with the Seller, without having to provide justification or incur penalties, in order to obtain an exchange or a refund, provided that the Products are returned in their original packaging and in perfect condition within fourteen (14) days following notification to the Seller of the Customer’s decision to withdraw.
Returns must be made in their original, complete condition (packaging, accessories, instructions, etc.), enabling them to be resold as new, and accompanied by the purchase invoice.
Products that are damaged, soiled, or incomplete will not be accepted.
The right of withdrawal can be exercised via email or postal mail by returning the withdrawal form provided, in which case the Seller shall immediately send the Customer an acknowledgment of receipt on a durable medium, or by sending any other unambiguous statement expressing the desire to withdraw.
In the event of exercising the right of withdrawal within the aforementioned timeframe, only the price of the Product(s) purchased and initial delivery costs will be refunded; return shipping costs remain at the Customer’s expense.
Exchange (subject to availability) or refund will be carried out within fourteen (14) days of the Seller’s receipt of the Products returned by the Customer, under the conditions outlined in this article.
Article 9 – Seller’s Liability – Warranty
Products sold on the website https://halloftime.be/ comply with applicable Belgian regulations and have performance characteristics suitable for non-professional use.
Independently of the right of withdrawal, and in accordance with legal provisions, the Products provided by the Seller benefit by law and without additional charge from:
- The statutory warranty of conformity for Products that are visibly defective, damaged, or do not correspond to the order placed;
- The statutory warranty against hidden defects arising from material, design, or manufacturing defects that affect the delivered Products, rendering them unsuitable for their intended use;
- Under the conditions and procedures defined in the annex to these General Terms and Conditions of Sale (“Warranty of Conformity / Warranty against Hidden Defects”).
To assert their rights, the Customer must inform the Seller in writing of any lack of conformity of the Products within a maximum period of two (2) years from delivery, or of hidden defects within a maximum period of two (2) years from their discovery.
The Seller will refund, replace, or repair under warranty any Products or parts deemed non-conforming or defective.
Shipping costs will be reimbursed based on the invoiced rate.
Reimbursement for Products considered non-conforming or defective will be made as promptly as possible and at the latest within thirty (30) days following the Seller’s acknowledgment of the lack of conformity or hidden defect.
The reimbursement will be processed either by credit to the Customer’s bank account or by bank check issued to the Customer.
The Seller shall not be held liable in the following circumstances:
- Failure to comply with the legislation of the country where the Products are delivered, which is the Customer’s responsibility to verify;
- Misuse, professional use, negligence, or lack of maintenance by the Customer, as well as normal wear and tear of the Product, accident, or force majeure.
In all cases, the Seller’s warranty is strictly limited to the replacement or reimbursement of Products deemed non-conforming or defective.
Article 10 – Data Protection
In accordance with Law No. 78-17 of January 6, 1978, personal data requested from the Customer are necessary for the processing of their order and the issuing of invoices, among other purposes.
These data may be communicated to the Seller’s partners responsible for the execution, processing, management, and payment of orders.
The processing of personal information provided via the website https://halloftime.be/ has been declared to the CNIL.
Under current national and European regulations, the Customer has a permanent right of access, modification, rectification, and objection regarding their personal data.
This right may be exercised according to the conditions and procedures detailed on the website https://halloftime.be/.
Furthermore, in accordance with Article L.223-2 of the Consumer Code, Customers have the right to register free of charge on the telephone marketing opposition list BLOCTEL (www.bloctel.gouv.fr), in order to no longer receive unsolicited marketing calls from professionals with whom they do not have an ongoing contractual relationship.
Every consumer may freely register on this list by visiting https://conso.bloctel.fr/index.php/inscription.php.
Article 11 – Intellectual Property
The content of the website https://halloftime.be/ is the exclusive property of the Seller and its partners and is protected under Belgian and international intellectual property laws.
Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement offense.
Furthermore, the Seller remains the sole owner of all intellectual property rights related to photographs, presentations, studies, drawings, models, prototypes, etc., created (even at the Customer’s request) for the purpose of providing Services to the Customer. Consequently, the Customer is prohibited from reproducing or exploiting these studies, drawings, models, prototypes, etc., without explicit prior written authorization from the Seller, who may grant such authorization subject to financial compensation.
Article 12 – Applicable Law – Language
These General Terms and Conditions of Sale and all transactions arising from them are governed by and subject to Belgian law.
These General Terms and Conditions of Sale have been drafted in French. In the event that they are translated into one or several foreign languages, only the French text shall prevail in the case of disputes.
Article 13 – Disputes
Any disputes resulting from purchase and sale transactions concluded under these General Terms and Conditions of Sale, concerning their validity, interpretation, execution, termination, consequences, and aftermath, and that could not be amicably resolved between the Seller and the Customer, shall be submitted to the competent courts under standard legal procedures.
The Customer is informed that they may, in any event, resort to conventional mediation, particularly through the Consumer Mediation Commission (Article L612-1 of the Consumer Code) or existing sector-specific mediation bodies, whose references are available on the website https://halloftime.be/, or any alternative dispute resolution method (such as conciliation) in the event of a disagreement.
Article 14 – Pre-contractual Information – Customer Acceptance
The Customer acknowledges having received, prior to placing the order and concluding the contract, these General Terms and Conditions of Sale and all information listed in Article L 221-5 of the Consumer Code, presented in a clear and understandable manner, notably the following:

By placing an order on the website https://halloftime.be/, any natural (or legal) person fully and unequivocally accepts these General Terms and Conditions of Sale and commits to the payment for the ordered Products. The Customer explicitly acknowledges this and expressly waives reliance on any conflicting document, which would be unenforceable against the Seller.
Article L217-4 of the Consumer Code
